Power of Attorney is a document that authorizes another person to make decisions and carry out actions on behalf of the author. It can be for a short term and within specific scope or continue (durable) after the death of the author.

General Power of Attorney
If you are thinking of appointing another person to manage your business, finances, properties or assets on your behalf during your absence in Thailand, it is crucial to have a Power of Attorney (POA) that will be accepted by all government offices. The POA can either be for a short term and limited scope (General Power of Attorney or GPA) or continue after your death and be called a “durable power of attorney”. Regardless of the type of POA, it is advisable to have it notarized.
The POA must be signed by both the Grantor and the Agent. The signature must be authentic. The completed form must be attached with a copy of the ID or passport of both parties. If the POA is executed outside of Thailand, it will require certification from a Thai embassy or consulate or a notary public Thailand.
Property Transfer Power of Attorney
A property transfer power of attorney is a document that grants an agent the legal right to purchase or sell real estate on behalf of another person. It’s typically used when the principal cannot be present for a specific transaction, like buying or selling a condo in Thailand.
Unlike a general POA, this type of power of attorney is limited to a specific transaction and only lasts for the duration of that transaction. Additionally, this kind of POA must be signed by two witnesses (instead of one) to make it valid.
Obtaining this document is required if a foreign buyer wishes to have someone represent them in the transfer of ownership at the Land Department in their absence. The form is specific to this purpose and follows strict standards as specified by the Land Office, known as Tor Dor 21. If the principal is outside of Thailand, they will need to have the completed form notarized by their embassy or consulate in their country of residence.
Financial Power of Attorney
The financial power of attorney allows the grantor to authorize another person or entity to manage their finances, properties and assets on his behalf. It can be used for short term specific transactions or can continue (durable power of attorney) in the event that the Grantor becomes incapacitated.
